Additional Information

A person can be placed under a mental health commitment (court ordered) to a hospital for treatment purposes if the person is ‘seriously mentally impaired’. There are three primary principles to determine this:

  • a person is now suffering from a recognizable mental illness, excluding mental retardation
  • the person’s insight and judgment into the need for treatment is at this time is impaired
  • the person has demonstrated a danger to themselves or others
